In the first-ever EEOC settlement over AI-driven age discrimination (Aug 2023), tutoring company iTutorGroup was caught programming its recruitment AI to auto-reject women aged 55+ and men aged 60+. Over 200 qualified applicants were filtered out before any human saw their resumes. The smoking gun: one applicant resubmitted the same resume with a younger birth date and was immediately invited to interview. iTutorGroup paid $365k and was forced to re-offer jobs to all rejected candidates.
